1. Agreement to Terms

These Terms of Service ("Terms") govern your use of UseFlowy ("we," "our," or "us"), a chatbot building platform. By accessing or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our services.

2. Account Registration

To use UseFlowy, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You may not share your account with others or create multiple accounts to circumvent our limits.

3. Use of Services

3.1 Permitted Use

You may use UseFlowy to:

• Create and manage chatbots for legitimate business purposes
• Integrate with WhatsApp Business, Telegram, and other supported channels
• Collect and analyze conversation data from your own users
• Collaborate with team members within your organization

3.2 Prohibited Activities

You may NOT use UseFlowy to:

• Send spam, unsolicited messages, or engage in harassment
• Violate any laws or regulations
• Infringe on intellectual property rights
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Reverse engineer or copy our software
• Use our services for cryptocurrency mining or similar activities
• Create bots that impersonate others or spread misinformation

4. Subscription and Payment

4.1 Plans and Pricing

UseFlowy offers different subscription plans:

• Starter: Free forever with limited features
• Professional: S/ 49/month or S/ 490/year
• Business: S/ 99/month or S/ 990/year
• Enterprise: S/ 199/month or S/ 1,990/year

4.2 Free Trial

New users receive a 14-day free trial of the Professional plan. No credit card is required to start the trial. At the end of the trial, you will be automatically downgraded to the Starter (free) plan unless you choose to upgrade.

4.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed securely through Culqi
• All fees are in Peruvian Soles (PEN) and exclude applicable taxes
• Failed payments may result in service suspension

4.4 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods
• Annual subscriptions are non-refundable after 30 days

5. WhatsApp Business Integration

5.1 WhatsApp Requirements

To use WhatsApp integration, you must:

• Have a valid WhatsApp Business account
• Comply with WhatsApp's Business Policy and Commerce Policy
• Obtain necessary consents from your users
• Not use WhatsApp for promotional messaging without opt-in

5.2 Conversation Limits

• Starter: 0 WhatsApp conversations (not available)
• Professional: 1,000 conversations/month
• Business: 5,000 conversations/month
• Enterprise: Unlimited conversations

5.3 Your Responsibilities

You are solely responsible for the content of messages sent through your bots and for complying with applicable laws and WhatsApp's policies. UseFlowy is not liable for your use of WhatsApp integration.

6. Data and Privacy

Your use of our services is also governed by our Privacy Policy. By using UseFlowy, you consent to our collection and use of data as described in the Privacy Policy.

You retain ownership of all content and data you provide to UseFlowy. We do not claim any ownership rights to your bots, messages, or user data.

7. Intellectual Property

7.1 Our Rights

UseFlowy and all related technology, software, and content are owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of our platform
• Decompile, reverse engineer, or disassemble our software
• Remove or alter any proprietary notices
• Use our trademarks without permission

7.2 Your Rights

You retain all rights to your content. By using our services, you grant us a license to host, store, and process your content solely to provide our services.

8. Service Availability and Support

We strive to provide reliable service, but we do not guarantee:

• 100% uptime or uninterrupted access
• Error-free operation
• Compatibility with all devices or browsers

We reserve the right to modify, suspend, or discontinue services (with notice when possible).

9. Limitation of Liability

To the fullest extent permitted by law:

• UseFlowy is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees you paid in the last 12 months
• We are not responsible for third-party services (WhatsApp, payment processors, etc.)

10. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees when due
• Engage in fraudulent or illegal activity
• Pose a security risk to our platform

Upon termination, you will lose access to your account. We may delete your data after 90 days.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Your continued use of UseFlowy after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Peru. Any disputes shall be resolved in the courts of Lima, Peru.
